Section 8 companies are those non-profit companies in India that are incorporated under Section 8 of the Companies Act 2013. These types of companies are incorporated mainly to promote commerce, the arts, science, sports, education, research, etc. These types of companies are incorporated with the objectives of charity and social welfare. The common examples of Section 8 companies are NGOs, trusts, cooperative societies, and microfinance companies.
Section 8 company registration process:
- For incorporating any section 8 company, one needs to apply for a Director Identification Number (DIN) and a Digital Signature Certificate (DSC). First, one needs to apply for the DSC. Any MCA-registered office can provide this service.
- The second step is to propose two names for their Section 8 company. If one is rejected, another resubmission is allowed in a different time frame.
- The third step is to get a MOA and an AOA. After filling out the forms INC-12 and INC-13, respectively, CA or CS sends INC-14 along with the declaration of directors in the form INC-15. After that, one can get the Certificate of Incorporation.
- After that, one can apply for the PAN and TAN of the company by submitting INC-7, 8, 9, 10, 22, DIR-2, and 12 along with the relevant documents.
